Debit Card Agreement and Disclosure
Statement:
The following information concerns
the use of electronic funds transfer services as required by
Regulation E. We are pleased to tell you about the rights and
responsibilities associated with Electronic Funds Transfer (EFT)
transactions. Some of the wording we use in this agreement and
some of the terms we must abide by are dictated by the federal
law.

When using a ATM/Debit Card, simply
insert your VISA Check Card into the machine, key in your Personal
Identification Number (PIN), then follow the step-by-step instructions
that appear on the screen.
When using a POS machine at a merchant,
just swipe your VISA Check Card through the terminal. If you
select the “credit” option, you will be asked to
sign the receipt. The withdrawal will clear your checking account
as a Merchant Sales Draft usually within three business days.
If you select the “Debit” option, you will need
to key in your PIN number. The transaction will clear your checking
account immediately, like an ATM withdrawal.
You can also use your VISA Check
Card to pay for your purchases at restaurants, gas stations,
department stores – anywhere you the see the VISA logo.
Your payment will clear your checking account as if you had
selected the “Credit” option.

Statement
The Cardholder Agreement and Disclosure
Statement (Agreement) governs the use of the Texarkana Terminal
Employees Federal Credit Union (TTEFCU) VISA Check Card. By
using the Card, you (the cardholder) agree to comply with the
terms and conditions of this Agreement and any changes made
by TTEFCU or its regulatory authorities. If you do not agree
to the agreement, you must notify us and return the Card.
1.Security of the Card and PIN.
TTEFCU has issued the card for your use only. Do not allow anyone
else to use or have access to the card and/or Personal Identification
Number (PIN). Keep the PIN confidential and do not keep it with
the card or write it on the card or card sleeve or where it
may be available to others. You are responsible and liable for
all authorized transaction made with the card. Use of the card
by you or anyone for your benefit or with a actual, implied,
or apparent authority is considered an authorized user.
2.PIN Numbers: You will be assigned a computer-generated PIN.
3.Charges for and Types of Transactions: With this card, you
authorize us to:
Withdraw funds from your primary checking account,
Withdraw funds from any of your primary accounts for purchases
made at any VISA participating merchants,
Withdraw funds from any of your primary accounts for transactions
made through any VISA ATM Network.
** No Deposits are allowed at ATM machines
** Funds subject to verification and Funds availability
(Regulation CC)
Transactions can be made 24 hours
a day, with no limit on the number of transactions you perform,
as long as you do not overdraw any of your accounts. Any overdraft
or insufficient funds resulting from the use of the Card will
be subject to TTEFCU’s normal charges and policies, including
but not limited to, NSF check and debit fees and overdraft fees.
You authorize us to debit any account you have or on which you
are joint owner at TTEFCU for funds obtained by authorized use
of the Card or for any charges incurred by authorized use of
the Card. You must continuously maintain your accounts and membership
in good standing with us and immediately deposit funds to correct
any overdraft amount. Fees may be charged on transactions at
any ATM or POS machine. The charges relating to usage of the
card are shown in the current fee schedule.
4.Accessible Accounts, The Card
will access your checking accounts with TTEFCU.
5.Stop Payment and Waiver. You waive the right to stop payment
on any draft issued against the account which has been properly
guaranteed.
6.Returns and Merchant Disputes. Merchants and others who honor
the card may give credit for returns or adjustments. This is
done by initiating a credit which will be posted to your account.
TTEFCU is not responsible for the refusal or inability of any
merchant or financial institution to honor the Card or for their
retention of the card.
7.Foreign Transactions. Transactions that are initiated in foreign
countries and foreign currencies will be charged to your account
in US dollars. The conversion rate will be made in accordance
with the operating regulations for international transactions
published by VISA International, Inc. through whose facilities
such transactions are handled.
8.Address Change. You must immediately notify TTEFCU of any
change in your address. You may do this in writing or in person.
All mail sent to your last known address will be considered
received.
9.Ownership of the Card. All TTEFCU Cards are the property of
this credit union and must be returned upon request. Use of
the Card constitutes acceptance of the terms and conditions
of the Cardholder Agreement at the time of acceptance as amended.
For security reasons, we reserve the right to revoke your authority
to use the Card at any time and after the accounts that the
Card accesses are closed.
10. Failure to Make Authorized Transactions. If we do not properly
complete transactions to or from your account as directed, we
will be liable for your reasonable losses or damages. However,
there are some exceptions. We will not be liable if, for instance,
(1) through no fault of ours, your account does not contain
enough available funds to complete the transfer, (2) your account
if frozen due to a court order or similar reason, (3) the transfer
would exceed the credit limit on your line of credit loan, (4)
any of your loan accounts are delinquent, (5) the ATM where
you are making the transaction does not have enough cash, (6)
the electronic funds transfer (EFT) system is not working properly,
and you know this at the time of the transaction, (7) you give
the ATM/POS improper instructions, (8) circumstances beyond
our control (such as fire, flood, or mechanical malfunction)
prevent the transaction, (9) your account is dormant, or (10)
the Card or PIN have been reported as lost or stolen, or we
suspect fraud or misuse. There may be other exceptions.
11. Account Information Disclosure. We will not disclose information
to third parties about your accounts or the transactions you
make except (1) when necessary to complete the transaction,
(2) to comply with a court order, (3) to verify the existence
of your membership/account, or (4) if you give us your permission.
12. Statement. You will get a receipt from the Automated Teller
Machine (ATM), merchant, or Point of Sale (POS) Terminal at
the time your make a transaction. You will also receive a monthly
statement detailing the EFT activity in your account.
13. Membership Liability for Unauthorized Card Usage. Contact
us immediately if you have reason to believe (1) the Card has
been lost or stolen, or (2) the PIN has been lost or stolen
or (3) an unauthorized transaction occurred on your account.
Inform us at once if your account statement shows transactions
that you did not make with the card. If you do not inform us
within 60 days after the statement is mailed to you, you may
not get back any money you lost if we can prove that your contacting
us would have prevented the loss. (A) VISA Check Card Liability
Limitations: You can lose no more than $50.00 if someone uses
your card without your permission and you inform us within 2
business days after learning of the loss or theft. You could
lose as much as $500 if someone uses your card without your
permission and you do not tell us within 2 business days after
learning of the loss or theft and we can prove that your contacting
us could have prevented the loss.
14. VISA Check Card Restrictions. You may not use your VISA
Check Card for any illegal purpose or transaction. TTEFCU may
refuse to authorize any transaction that TTEFCU believes to
be illegal or that poses an undue risk of illegality. You agree
that any illegal use of your VISA Check Card will be deemed
an act of default under this Agreement. You further agree to
waive any right to take legal action against TTEFCU for your
illegal use of your VISA Check Card and to indemnify and hold
TTEFCU harmless from and against any lawsuit, other legal action
or liability that results directly or indirectly from such illegal
use.

In your correspondence with us, please include your name, your
member number, the account number, the Card number, and a daytime
phone number.
16. Report your lost or stolen Card or PIN to (903) 794-8216.
17. Business Days. A business day is any day, except Saturdays,
Sundays, or Federal Holidays.
18. Changes in Terms and Conditions. TTEFCU may amend, modify,
or restrict this Agreement at anytime upon taking one or both
of the following step: Mailing a written notice of such amendment,
modification, or revision to your last known address as shown
on our records at least 21 days prior to the effective date
of any such change. TTEFCU may also terminate the Agreement
at anytime without notice in the event that your account is
closed or overdrawn or if you are not in good standing with
us.

As soon as you can if you think
your statement or receipt is incorrect or you need more information
about a transaction on the statement or receipt. We must hear
from your no later than 60 days after we sent you the first
statement on which the error or problem appeared.
(1)Tell us your name, your member
number, the account affected, and the card number
(2)Describe the suspected error or the transaction you are unsure
about and explain as clearly as possible why you believe that
there is an error or why you need more information.
(3)Tell us the dollar amount of the suspected error.
If you tell us orally, we may require
that you send us your complaint or question in writing within
10 business days. We will tell you the results of our investigation
within 10 business days after we hear from you and will correct
any error promptly. If we need more time, we may take up to
45 business days to investigate your complaint or question.
If we decide to do this, we will credit your account within
10 business days for the amount you think is in error, so that
you will have use of the money during the time it takes us to
complete the investigations. If we ask you to put your complaint
or question in writing and we do not receive it within 10 business
days, we may not credit your account. If we decide that there
was no error, we will send you a written explanation within
3 days after we finish our investigation. You may ask for copies
of the documents that we used in our investigation.
